Local Preston man wins £4million brain injury settlement

A man from Cottam, Preston has just been awarded £4million pounds in a medical negligence claim, following severe life changing injuries.

The man, who was 11 at the time, suffered with a serious thyroid condition, which went undiagnosed and untreated throughout most of his childhood, despite attendance at Sharoe Green Hospital. He collapsed and suffered significant and devastating brain injury.

The thyroid condition would have left him with difficulties but the trust agreed that their negligence made his condition worse and resulted in greater life altering disabilities.

Carlos Lopez, Head of Clinical Negligence at Vincents Solicitors, stated, “ For so many families, a settlement marks the end of a long journey and the relief of receiving a life changing, and just award, is often mirrored by the relief that the litigation is finally concluded. “This case was reported as being serious and complex in its nature and highlights the need to get specialist advice from medical negligence solicitors”

The Judge, Mr Justice Swift, dealing with the case not only praised the mans’ extraordinary courage but also the commitment of his mother, who had supported him since the collapse.

The case, which took 14 years, was successfully settled with an award of £3.9 million damages and highlights the significant consequence of brain injury, and the devastation that can result.

Denise Singleton, Litigation Executive in Vincents’ medical negligence team commented, “Awards of this nature allow those injured through medical negligence to get on with their lives with the support of specialist equipment and rehabilitation.”

Speaking to a local newspaper, the Claimants’ mother,“He will be able to enjoy a lot more things and will have a better quality of life”. “It is such a relief for the case to have settled and to start putting that side of things behind us.”
“Now we can focus even more on ensuring that he has everything he needs to have the best quality of life.”

Carlos Lopez, commented, “so often in medical negligence claims, awards of damages are needed to help rebuild a persons life, to restore dignity and an acceptable standard of living. “
