Whiplash claims being small claims will eliminate justice for Claimants
The government are currently consulting on raising the small claims limit for whiplash claims from £1,000 to £5,000. This would mean that where someone has suffered whiplash they would not be able to use a lawyer as their legal costs would not be paid.
Instead, it is likely that claims management firms would step in (as they have with PI claims) leading to cold call and text messaging and potentially increasing claims – the exact opposite of what it is hoped the rise will achieve.
